All ARCS Services provided by ARCS Operators are to be used for Research and Education Purposes only unless there is a written agreement with the ARCS Operator that is delivering the respective Service or Tool that specifies otherwise.

The ARCS Services are to be used in an efficient and economical manner. The ARCS Operators will use reasonable endeavours consistent with their prudent commercial practices to deliver ARCS Services with high quality, however no liability can or will be accepted for any loss or damage resulting from the use of ARCS Services.

Password, Account and Identity
In the course of using any ARCS Services, you may not allow any person to use your password or to share your account. It is your responsibility to protect your account from unauthorised use by changing your password periodically and using passwords that are not easily guessed. You are responsible for all use of your account and password and will not do anything to disguise your identity or usage of ARCS Services.

When Using ARCS Services
In accessing or using ARCS Services you:

  1. will act conscientiously, honestly and diligently;
  2. will not view, copy, upload, download, send, publish or transmit, whether by email, voice mail or otherwise any defamatory, slanderous, misleading or deceptive material or material of an illegal nature;
  3. will adhere to all applicable occupational health and safety, equal opportunity, anti-discrimination, sexual harassment, privacy and other laws in operation from time to time;
  4. will adhere to your organisation’s/ university’s email and web surfing protocols;
  5. acknowledge the express prohibition on the viewing, sending or downloading to, from or on any ARCS Systems (including any ARCS Operator’s computer or device), of any material of an illegal, sexually explicit, racist, violent or offensive nature;
  6. consent to ARCS Operators monitoring use to ensure compliance with this Policy;
  7. will properly utilise all Services provided by ARCS Operators;
  8. will not use, or attempt to use, ARCS Services without prior authorisation or for unauthorised purposes;
  9. will not tamper with or obstruct the operation of ARCS Services or attempt to do so;
  10. will not use or attempt to use the ARCS Services in any way which damages, interferes with or interrupts the ARCS Services or any telecommunications, or information technology network, equipment, software, system, facility, or cabling (whether such telecommunications, or information technology network, equipment, software, system, facility, or cabling is owned or controlled by any ARCS Operator, by a supplier of equipment or services to any ARCS Operator or by any third party);
  11. will not use or attempt to use the ARCS Services in any way which may cause or, in any way, cause damage to the property of any person or which causes, or may cause, the death of, or injury to, any person.
  12. will not use, or attempt to use, or by action or inaction allow the ARCS Operators’ Systems, or ARCS Services to be used to transmit, publish or communicate material which is defamatory, fraudulent, offensive, libellous, obscene, pornographic, seditious, tortuous, abusive, indecent, threatening, menacing, harmful (including, but not limited to, any use involving any Viruses, corrupted files, or any other similar software or programs) or is otherwise objectionable or is unwanted by any person in receipt of the material;
  13. will not view, inspect, modify, distribute, or copy material, data or software without proper authorisation, or attempt to do so; and
  14. will not use or supply, or attempt to use or supply, false or misleading information or identification in order to access ARCS Services .

Damage
Damage caused to ARCS Services (including damage to software databases and computer or related equipment) though misuse, abuse or neglect by you as user will be your responsibility and the costs of replacement, repair or rectification will be met in full by you. You will be liable for any damages and costs incurred by or suffered by any ARCS Operator, any other user of ARCS Services, and any third party, arising out of or incidental to your breach of this Policy

Return of Records
All records, documents, materials, diaries, disks and equipment belonging to any ARCS Operator must not be removed (whether physically or electronically via email or otherwise) from the premises at which the ARCS Operators’ computers and related equipment are located except for the purpose of enabling the user to perform their authorised and lawful duties.

Intellectual Property
You must not install software or upload data onto any ARCS Operators’ Systems without the prior written permission of ARCS.

In the course of using any ARCS Services, users must not infringe the copyright or other Intellectual Property Rights of (i) ARCS Operators (ii) any user of ARCS Services or (iii) any third party Intellectual Property Rights.

In particular in the course of using any ARCS Services, unauthorised use or copying of software or documentation is not permitted.

The use of ARCS Services must be consistent with all contractual obligations of ARCS Operators notified to the user.

The User must comply with the terms and conditions of any licence or other agreement relating to third party software or other goods or services, of which the User is or is deemed to be aware.

Security Policy
An ARCS Operator may terminate or restrict any user's access to ARCS Services without prior notice, if such action is in that ARCS Operator’s sole discretion to be necessary to maintain service availability, security, for maintenance purposes or for any other reason.

All security holes and violations of this Policy must be reported. Any user who finds a possible security hole on any ARCS Operator’s System or who becomes aware of breach of this Policy by another user must report it immediately by emailing This e-mail address is being protected from spambots. ARCS may also remove any information, data or other material uploaded onto, transmitted or communicated by, or via any ARCS Operator’s Systems including, without limitation, if such material is in breach of this Policy.

Publications
All publications, material, books, articles, newsletters or other literary or artistic works resulting from the use of ARCS Services must acknowledge ARCS and ARCS Operators using the standard publication clause “This project was supported in part by Services developed by the Australian Research Collaboration Service (ARCS) through funding from the Australian Commonwealth Government Department of Innovation, Industry, Science, and Research and provided by the ARCS Operators.”

Civility
Users must not harass other users using computer resources, or make repeated unwelcome contacts with other users.

Users must not display or store material that is inappropriate, potentially offensive or inconsistent with the legitimate use of ARCS and related third party Services.

Applicable Laws
Users must obey all local, state, and federal laws (including, without limitation, laws on copyright and other Intellectual Property Rights, privacy and Occupational Health and Safety).

Governing Law
This Policy will be interpreted in accordance with and be subject to the laws of the State of incorporation of each ARCS Operator as regards their respective Services , and applicable Commonwealth legislation. The User irrevocably submits to the non-exclusive jurisdiction of the respective courts and any courts hearing appeals from such courts.

Glossary
ARCS” means the Australian Research Collaboration Service established in 2007 by the NCRIS/PfC initiative to facilitate long-term eResearch.

ARCS Operators” means eResearch South Australia, iVEC, the Queensland Cyber Infrastructure Foundation Limited, Intersect Ltd, the Tasmanian Partnership for Advanced Computing, and the Victorian Partnership for Advanced Computing Ltd.

ARCS Services ” – includes the ARCS Data Fabric and Access Service, the ARCS Grid/Cloud Service and the ARCS IdP Service, and the ARCS Videoconferencing Service.

Intellectual Property Rights” means any statutory and other property rights in any copyright work (including copyright work or item created in the future), patentable invention, design, circuit layout, trademark, know-how or trade secret and all other forms of intellectual property as defined in Article 2 of the Convention establishing the World Intellectual Property Organisation of July 1967.

Policy” means this Acceptable Use Policy and any updates;

Viruses” means any viruses, time-bombs, back doors, trojan horses and any other form of malevolent or defective code or similar software, programs or other item or material.
