Purpose
This Policy outlines in general terms the rights and obligations of users of ARCS Services provided by the ARCS Operators. Any person who uses ARCS Services does so subject to and in accordance with the terms and conditions outlined in this Policy.
Users of the ARCS Services will be deemed to have acknowledged and agreed that the terms and conditions outlined in this Policy are legally binding on them. If a User does not wish to be bound by these terms and conditions, the User should not use the Services. Once a User access or uses any of the ARCS Services, that User is understood to have accepted this Policy.
This Policy and associated policies may change over time and the most recent version will supersede all previous versions. Users of ARCS Services (or their employer, university or organisation) should check the ARCS website at www.arcs.org.au regularly for updates to all applicable ARCS policies.
Confidential Information
For the purposes of this Policy “Confidential Information” means all information relating to the past, present and future business, inventions (including unpatented inventions), technical information, trade secrets, know how, records, processes, marketing, procedures, financial information, customer and supplier details, source and object codes, manuals, costings, prices and any other information reasonably regarded as confidential, whether belonging to an ARCS Operator, any user of ARCS Services, or a related corporation or organisation, in whatever form and howsoever stored, but shall not include information which is or comes into the public domain otherwise than by breach of this Policy.
In the course of using any ARCS Services you will not (except in circumstances required by law or otherwise authorised by the relevant owner of such Confidential Information) divulge, communicate or use, whether directly or indirectly any Confidential Information. This obligation of non use and confidence continues after you have ceased using any ARCS Services.
General
All ARCS Services provided by ARCS Operators are to be used for Research and Education Purposes only unless there is a written agreement with the ARCS Operators that specifies otherwise.
The ARCS Services are to be used in an efficient and economical manner. The ARCS Operators will use reasonable endeavours consistent with their prudent commercial practices to deliver ARCS Services with high quality, however no liability can or will be accepted for any loss or damage resulting from the use of ARCS Services.
